An official copy of the Order, certified by the court within the last 90 days, should be sent either certified mail or registered mail (return receipt requested) to the following address:

Accompanying the Order should be a completed application form entitled "Request for Former Spouse Payments from Retired Pay" (DFAS Form 2293).

If the Former Spouse was awarded a Former Spouse Survivor Annuity ("SBP") under the terms of the Order, accompanying the court approved Order should be a letter indicating that the Former Spouse would like to make a "deemed" election for the Survivor Benefit Plan. In order for a former spouse to be eligible for the SBP coverage, the Member must make an affirmative written benefit election for such coverage within one year of the date of the divorce. In order to protect the Former Spouse's eligibility for this SBP coverage in the event the Member neglects or refuses to make the appropriate election on behalf of the Former Spouse within the one year time limit, a letter should be sent with the Order stating that the Former Spouse is making a "deemed" election for this SBP coverage. This letter must be sent within one year of the date of the Court Order.

If the Former Spouse intends to make a deemed election for SBP coverage a second copy of the Court Order should be sent, accompanied by the letter indicating a "deemed" election is being made to:

Copies of all documents sent should be retained in your files. If the documents are not sent by certified mail or registered mail they will be returned to you by the finance center.
